The sentences handed down by Judge Dena Martin gave Carter the maximum amount of time behind bars that is allowed by Indiana law plus extra time for being an habitual felony offender.
Carter was initially charged with three felonies and one misdemeanor: Sexual misconduct with a minor, a class C felony; two counts of child solicitation, both class D felonies; and recklessly furnishing alcoholic beverages to minors, a class C misdemeanor.
However, the first count of a C felony sexual misconduct and one of the D felony child solicitation counts was later dismissed by the prosecution.
Under the terms of a negotiated plea agreement, Carter agreed to plead guilty to the remaining two counts which were one count of child solicitation as a class D felony and the class C misdemeanor of furnishing alcoholic beverages to minors plus a sentence enhancement for being an habitual felony offender.
The state was represented by Chief Deputy Prosecutor Cheryl Jackson Stone and Carter was represented by Public Defender Alan K. Baughman.
The 43-year-old Carter is listed as a "Sex Predator" with an alias of "Caveman" on Indiana's Sex and Violent Offender Registry.
Carter was arrested Feb. 13 by Det. Sgt. Keith McDonald of the Linton Police Department following an investigation into a complaint of alcohol and sex parties being hosted for minors by Carter at his residence on Glenburn Road in Linton.
The investigation began when one of the children involved came to the police station with a parent and reported the situation to LPD Cpl. Chad Crynes who called McDonald.
During interviews with several children, the officers were told that "all the kids knew Vincent as dad or daddy -- Vincent told them to call him that," and that he charged kids $5 to drink alcoholic beverages at his mobile home. He allegedly purchased rum, vodka and whiskey for the kids to consume.
When Det. Sgt. McDonald conducted an interview with Carter on Feb. 10, Carter denied letting anyone else drink alcohol and denied having any knowledge of sexual activity at his house. He said his porn video was never played while anyone else was there.
According to the probable cause affidavit, Carter told the officer that underage drinking and sexual activity could have happened while he was sleeping and he named 12 minors ages 12 to 18 that were visiting and spending the night at his house.
The affidavit contained information obtained in interviews with five minors but McDonald wrote that the investigation had revealed approximately 12 other juveniles were involved in consuming alcoholic beverages and participating in sex acts at the Carter residence.
He added that all those interviewed agreed that these parties occurred on Friday and Saturday nights somewhere between four and eight weeks prior to Feb. 9.
When Carter was arrested, his bond was first set at $18,500 but the Greene County Prosecutor's Office moved quickly to request the amount be increased.
During Carter's initial hearing, Deputy Prosecutor Keven McIntosh said the state does not usually ask for increases but they were in this case and he cited Carter's previous class A felony conviction for child molesting and another conviction for failure to register as a sex offender.
"Given his history, the state is asking for bond to be elevated to $75,000," said McIntosh.
Greene Superior Court Judge Dena Martin granted the request and Carter has remained in the Greene County Jail since the day of his arrest.
If Carter's case had gone to trial, and if he had been convicted on both counts, the possible punishment under Indiana law for the class D felony count of child solicitation ranged from six months up to three years with a fine up to $10,000, and for the class C misdemeanor of recklessly furnishing alcohol to minors -- up to 60 days in jail with a fine up to $500.
On Monday, Judge Martin's pronounced these sentences: For the child solicitation, Carter will serve three years in the Indiana Department of Corrections (DOC) with credit for days already served and pay a $100 fine plus court costs, and for the misdemeanor furnishing alcoholic beverages to minors, he will serve 60 days in the Greene County Jail with credit for 30 days served. The habitual felony offender sentence enhancement will add one and one-half years to Carter's time in the DOC.
Carter's sentences are to be served consecutively rather than concurrently.

the drug dealers get more time than this! maybe if the dealers would invite the prosecutor's kids over for a sex party they would get less time like "caveman". this is an outrage!!! with good-time and time-cuts he'll be back on the streets in a couple years if not sooner
I'm looking at my 12 year old, baby-faced, innocent little daughter while I'm reading this story...how the HE** does a sick monster like this get away with such behavior in this state??? I say lock him in a room with a few outraged fathers and some ducttape for 10 minutes...that would be a start.
Our legal system has failed
A "slap" is all that Indiana state statutes allow. our state legislature, who makes the laws, should be contacted, if we as a community, believe that justice is not being served. Judges only have the ability to work within the law. Remember the old phrase, "Don't kill the messenger." Judges must follow state statutes, otherwise there is no reason to have laws.....right?
It is shocking that this is the maximum amount that the Judge can give him according to Indiana law. Something's definitely needs to be changed in our laws, we need to lock these child predators up and throw the key away. Disgusting! He'll be back out in no time and back to doing it again.

Hard to believe he received the maximum sentence the law will allow when others who have done things less hideous than this have been given more time for their crimes. Do we really want this person for judge? My hunch is that if she runs for re-election, there will not be many votes go her way. I have a young granddaughter who will start school soon and I really detest the idea that he could be out on the streets again looking for more young innocent victims.
The judge can't change the law.

Great job Dena. as ugly as this guy is, you wouldn't have any trouble picking him out in a crowd. What are kids doing hanging around this guy in the first place.. Do you know where you child's at?? If you worry about their where-a-bouts, you can track them with their cell phones. If they tend to turn them off, ground them... ohh yeah.
Why doesn't Indiana have the 3 strikes and your in for life ? This might make people think. We are getting alot of people from Calif because they have 2 strikes. This might be something for our Ind Representatives and Senators to think about and maybe we can get rid of the people that like to break the law and make it safer for all of us.

The law is the problem not the judge. Maybe you should get your law degree or at least read the laws before you speak so harshly about such an upstanding person in the community. She is a person with a vested interest in this county, yet she can only do what the law allows. Read Anna Rochelle's blog and maybe you will understand this better.
This is just another example of our numerous flaws in today's Judicial System, but there are never any changes. My son recieved 22 years in prison for a FIRST time drug offense and this slime ball gets less than 2 years for scarring teenaged children. People say it is not the judges fault but I disagree. They have more discretion of sentences. I don;t know how some of these judges sleep at night!
I think Dena did all she WAS ALLOWED to do by law. She is a good person and a great judge...
We all know what this monster looks like it will just be our jobs as a community and as parents to know what our children are doing and who they are doing it with I will keep an eye out for this disgusting Piece of garbage.... It is a shame though that people are doing far more time for things not even close to what he did..
I think Dena done all she could with her hands tied by the judicial system. Its not her fault our law makers arent smart enough to make stricter laws. Im sure it was hard for her to pass such a light sentence on the guy knowing she has young children. Me personally I think she is alot better than some past judges. And if she runs again---Shes got my vote!
