George A. Foote, Jr., 37, who now resides in rural Sullivan County, will find out his fate on Tuesday when a sentencing hearing is conducted in Greene Circuit Court at 1:30 p.m.
Greene Circuit Judge Erik Allen will preside over the hearing that county prosecutor Jarrod Holtsclaw expects will last about two hours.
Foote was found guilty by a Knox County jury that was transported to the Greene County courtroom after four days of testimony of two counts of child molesting -- both class A felonies and was declared guilty of one count of incest -- a class B felony; and one count of incest -- a class C felony.
Foote faces between 48 and 128 years in prison -- plus a fine up to $40,000 -- based on state presumptive sentencing guidelines.
Prosecutor Holtsclaw isn't saying yet what kind of sentencing recommendation he will make to the court.
"You'll hear it on Tuesday. I'm still working on that, he told the Greene County Daily World on Wednesday,
Holtsclaw said he anticipates a couple of witnesses will testify on behalf of the state, but he's not sure at this point.
"I don't know whether the (two) girls (the victims in the case) will be strong enough to go back in front of him again," the prosecutor said. "I would anticipate having at least a couple of witnesses and I can't tell you if the defense will have any witnesses -- if so, how many. I would think the sentencing due to the length of the trial and the nature of the offenses and the things the court has to cover, I would think it would take a couple of hours."
Holtsclaw said a serious crime was committed and he intends to seek a sentence that reflects that fact.
"It's just a very, very serious violations of the law and the jury has returned its verdict and now it's time for Mr. Foote to find out what his punishment is going to be," Holtsclaw said.
After his August trial, Foote was ordered into the custody of the Greene County Sheriff's Department and is being held without bond.
This is the second time Foote faced a jury.
A mistrial was declared in April when a problem arose with a juror prior to testimony on the fourth day of the trial.
Foote was arrested in October 2007 following an investigation by the Greene County Prosecutor's Office and the Greene County office of the Indiana Department of Child Services that started on March 13, 2007.
On that day, one of the two female teen victims went to a guidance counselor at Bloomfield Junior-Senior High School and said she and her sister had been molested multiple times by Foote over the last four years.
Both girls testified in both trials that Foote repeatedly molested each of them dating back about to at least 2004.
The girls -- now 17 and 16 -- have been adopted by foster parents and are now living outside of the county.
