Both charges are class A misdemeanors.
No arrests were made at the time of the incident but late on Friday, the court approved the charges and ordered summons be sent to both Brown and Breneman to appear in court. Their initial hearings will be scheduled for dates in late September. No arrest warrants will be issued.
The charges were filed in connection with an investigation into an incident which occurred July 15.
In probable cause affidavits filed in both cases, Greene County Sheriff's Det. George Dallaire wrote that he assisted Deputies Bobby Pierce and John Fowler with a complaint of rape.
Other deputies had located Brown near Goodman Lake in Greene-Sullivan State Forest in Greene County, and she alleged she had been raped and battered then left there by Breneman and the other deputies had taken her to the hospital.
According to the affidavit, Brown's story was that she had agreed to perform oral sex on a man she had met in Linton the same day for $60 but she intended to trick him and never intended to go through with it. The man was determined to be Breneman. She said she got into his vehicle and went to a store in Linton to purchase vodka and cigarettes and then went to Goodman Lake where she was raped and battered. She said the marks on her were from this attack and the man would also have numerous marks.
The affidavit states that Breneman was located a couple hours later at Goodman Lake. He said he had returned to look for Brown because he felt bad for leaving her at this location.
According to the affidavit, Breneman's story was that he had met Brown earlier in the day in Linton and she asked him to purchase alcohol and cigarettes for her and she could make him happy. They came to an agreement -- Brown initially wanted $10 cash included but he did not agree. He purchased the vodka and cigarettes for her then drove to Goodman Lake where she performed oral sex on him and they had intercourse.
The affidavit states, "Corey Breneman said after he had sex with Eydan Brown, he left her at Goodman Lake. Corey Breneman drove away as Eydan Brown was standing outside his vehicle getting dressed."
Dallaire wrote that Breneman had no marks on him and that Brown appeared to have been mad about being left at Goodman Lake and made up the rape allegations in an attempt to get even with Breneman.
