Two arrested for intimidating a witness

Two persons, one adult and one juvenile, were taken into custody Wednesday after allegedly intimidating a witness in an ongoing criminal trial.

Kylee R. Barnes, 18, Worthington, was booked into the Greene County Jail at 12:15 a.m. after she was arrested by Indiana State Police Trooper Eric Russell.

A preliminary charge of intimidation, a class D felony, was filed against Barnes in Greene Circuit Court late in the day.

According to a probable cause affidavit written by Russell, both Barnes and the juvenile had been in attendance, observing the criminal trial of State of Indiana v. Jonathan Towell which began Tuesday in Greene Superior Court -- they were "showing support for Jonathan Towell." The affidavit states that Barnes is a friend of Towell.

An incident reportedly occurred around 5 p.m. on Tuesday when Barnes was a passenger in a white Ford Mustang being driven by the juvenile.

The pair allegedly drove past the residence of John and Theresa Penick in Linton.

John Penick was a state's witness in the Towell trial.

According to the affidavit, as Penick's wife was sitting on her porch, the juvenile said to her, "Your whole family is dead."

Penick advised that he also saw the same vehicle drive by at approximately 5:15 p.m. and the two occupants yelled to him that his whole family "is dead."

On Thursday morning, while the Towell trial continued in Superior Court on the second floor of the courthouse, Barnes appeared at her initial hearing on the intimidation charge in Circuit Court on the third floor.

Bond was set at $4,000 -- cash only, and the date of Nov. 25 was set as the date of her trial.

No further information is available on the juvenile.

i dont think the teens name should of been listed nor the female that was. all of this is just one man and his family trying to put people in jail to keep his name off the street. the story at top is nothing but a lie. this man has done nothing but harrass these girls and others. so where does the no toleration come in there? there has been many reports on this man and he is very dangerous. i think that if anyone is to be making excuses it should be the LPD for why this man is not behind bars like everyone else is???? and the update on the girls is that the 18 year old was released from jail and is wating for trail on the 25th of november. the 17 year old girl will be released from house arrest on the 27th for her 18th b-day. (happy b-day girl) and is waiting her trail on the 16th of sept... but ithink that who ever on here dont know these girls should ask around. these girls wouldnt hurt anyone and also wouldnt yell things like that at a grown man...

I agree with FTM on the juvenile's name being released. I have a teenager and a pre-teen and I want to know who my kids are talking and hanging with. How else do u make informed decisions other than going by what this or that person has said.

I think the juveniles name should be listed in the story as well, if you are old enough to drive a car, you are old enough to have your name in the paper when you do something stupid and get taken into custody for it.

Once again there is "NO" excuse that validates driving by someones house and screaming "Your whole family is dead".

And just maybe people don't know these "sweethearts" as well as they think they do.

I know nothing about any of these people, What I do know however, is, right is right and wrong is wrong. And this was totally wrong and should not be tolerated, nor excuses made for them. There is way too much of that, that goes on.

"Oh my, not my little poopsie". "They could never do that".

That's why you have children doing things today that the teenagers would not have done 30 years ago.

No consequences for nothing!!

i think before anyone goes around talking in suck a way about these females they should look into the story more. this man as not only once but many time "intimidated" these girls. i know both of them and i think it is sad to see these two innocent girls going through this. and i also side with mr. barnes who stats what this man has done. he states nothing but the truth. he also hes left out many things this man has done. andi think that people shhould do a little information gathering befor they state their mind. barnes you are true this man is nothing but bad news and if anyone should be behind bars it should be him not these young girls. and what is there to tolerate?? a man running the town of linton??? if that is so then what will linton become?? i guess the saying is true if you want to get away with murder move to greene county.

What is sad is that people think it is ok for others go around threatening people cause "she is a sweetheart". How sweet can she be yelling that at people?

Its to bad you only get one side of the story.I'm the brother of the one Kylee R Barnes she is a good person with a big heart.She is not white trash this man they were suppost to be intimidating does alot of that himself.Nothing has been done about him just because someone is a key witness does that mean they can do anything they want well this man seems to think so.He's the one that should behind bars not my sister.I know of one case when I was in Iraq he forced his way into my fathers house and was threating my sister and father what do you call that isn't that wrong.I know of alot other people that have the same cases with this man.When are these LPD finest gonna do something about him.Is it gonna take him hurting someone really bad for them to act.Ask anybody in Linton about this man and they'll tell you he's nothing but bad news.

I think it is alot of crap i know both girls and and they are sweethearts and people should think about all the other things that go on and their is nothing done , why make an example of them? i dont blame people for not tolerating this kind of stuff but u have to look at other things that people are getting by with and nothing is done so why punish them and not the other people that is not right!
