Linton putting more bite in nuisance animal law

Are the neighbors' dogs keeping you up? Do you hear yip-yipping all day and night?

Well, if you live within Linton's city limits there's an ordinance for you.

The purpose of the city's animal ordinance is to regulate the disruption certain animals cause that disturbs peace, affects the health, safety and welfare of the citizens, visitors and the city of Linton and to protect animals from adverse behaviors of humans, ordinance #2006-13 states.

But, it seems that part of the ordinance may be hard to enforce.

Linton Police Chief Troy Jerrell explained, "The barking dog is tough. A dog may bark once or twice and quit and then you get there...."

The LPD currently works the ordinance off a complaint basis, Jerrell added.

"Obviously, if a dog barks one or two times that's not a problem it's the one that barks all night," he said. "The first time we get a complaint we try to let them work it out. If they can work it out between themselves that's always best."

But, if a person can't the next step is taken.

"If we have to intervene two or three times there's fines. But, it's just a tough issue to work with...Dogs bark by nature and some bark more than others."

Fine penalties range from $100 to $2,500 depending on the violation.

Dogs not on leashes are also dealt with under this ordinance.

He explained, "People are required to have an animal on a leash in city limits or they are to be penned up or chained up."

If a dog is reported loose then it can be picked up and taken to the Greene County Humane Shelter (GCHS).

"What happens is Animal Control Officer Chuck Botsford will pick the animal up...," Jerrell explained, noting that it is held for a certain period at the GCHS.

The LPD has the only full-time animal control officer in the county, he noted.

"I think it's in everybody's best interest to keep animals penned up or on a leash. The thing I hear most commonly is 'My dog is a good dog and wouldn't ever bite anyone'," the police chief explained.

That may be true around the dog's owner, he added. But, dogs act differently around strangers.

"It's all around safer for the animals and the citizens to keep the animals on a leash or penned up," he added.

The ordinance defines actions by animals that constitute a public nuisance as the following:

* Attacks other animals or persons.

*Barks, whines, howls, cries, whimpers or makes sounds common to its species, continuously for 15 minutes or for a total of 20 minutes in a one-hour period.

*Interferes with a person passing by or passing vehicles.

* Damages private or public property.

* Defecates upon public or private property, and the owner refuses to clean up the pet's mess.

This ordinance also clearly states actions by humans that constitute a public nuisance in the proper conduct, care and treatment of animals as the following:

* Is prevented from running freely on property other than private property owned or lawfully occupied by its owner by means of a leash, animal-appropriate chain or other physical restraint.

* Is not transported in the open bed of a vehicle unless confined in a proper manner to prevent the animal from jumping or being thrown out of the vehicle.

* Is kept clean, healthy and not confined or forced to sit, stand or lie in excrement.

* Has sufficient wholesome food and water.

* Has a proper and adequate structure that is clean, offers protection from the elements and allows the animal to stand, sit and lie down without restriction.

* Receives proper and necessary veterinary care for treatment of illness of injury.

* Is not beaten, cruelly treated, overloaded or overworked.

* Is not abandoned, neglected tortured.

* Does not become a public nuisance.

* Does not bite, kick, butt, claw, attack or otherwise create a danger to the health and/or safety of other animals or human beings.

* Is properly vaccinated.

* Is not left unattended in a vehicle when conditions in the vehicle constitute a health hazard.

* Does not defecate on the property of another unless the person responsible immediately removes the feces.

I agree with you minerman it's animal abuse to chain up a dog and leave it, I think this should be treated the same as it would be if you didn't feed your dog. If people would have some common sense and not get some huge man eating dog in town it would help alot. I think if you live in town at the very least you should have to keep your dog in the house. Your are exactly right minerman if they truly loved their dog they would not leave it chained up all the time. It's not the dogs fault for the barking it's because when they are chained up all the time they get bored and start barking. It's the owners fault for all the barking. Well vincennes I feel for you I hope you own a shotgun because I know what I would do if that big dog ever crosses the fence. Why would anyone own an aggressive dog in town especially, you are just asking for a lawsuit when it bites someone. My neighbor does not clean up any of his dog's doo doo but i'm glad i now know he is souposed to.People really need to think about all of the responsibility of owning a dog before they get one.

Right on Lateralis! Who are those stupid people trying to impress with their loud pipes! Anyone who IS impressed is just as stupid! The noise ordinance definately needs enforced. And, four-wheelers shouldn't be in town either. I'm just glad I live in the country where the loudest thing to wake me in the morning is usually a Blue Jay.

Lateralus--I couldn't agree with you more on the loud trucks. Thats an all day and all night ordeal around my neighborhood.

I agree about the 4-wheelers, I have them on my side of town too. More annoying than a dark barking in my opinion. I can usually block out the barking dogs.

What about the people who have sound systems in there vechiles that are so loud that your windows are rattleing in your house because of the bass. When are you going to start doing something to these people?

So if the pet poops out at the park, does the person have to clean that mess up too?

Corb300-NO animal has a better life than ANY person. People in prison get walks around "the yard" everday and 3 squares a day-plus free reign in their cells. Ask them how happy they are.

just sayin-your right on. I have several nieghbors with those types of dogs-they should be fined everytime they start barking.

This article has made me aware of the law and I will start calling in every dog that falls in these guidelines. If the owners aren't smart enough to respect the law-THEY SHOULD BE FINED!

lacydee-4 wheelers being allowed on the streets was the dumbest decision ever made by the City-I feel your pain. Just like dogs are meant to be in the country=4 wheelers were made for off road use & not on city streets!

First off, my two dogs have a better life than most people. They are not chained, they get walks around the block every other day or so, they have the run of the house, backyard via the dog door. So yes, even town dogs can have a good life. Oh yeah, they eat well too.

I don't mind a dog who barks now and then, but 2-3 blocks over in my neighborhood is a house with one of those yipper type of dogs that drives me insane.

You can't have your windows open in the spring without listening to it all day long, and they must believe in letting it start the day early, because it generally starts it's yipping about 6:00 a.m.

If I lived any closer to the house, I'd probably invest in one of those ultrasound devices that goes off if they bark too long. Harsh for the animal perhaps, but I don't think everyone within a 4 block radius should be subjected to hearing it, and the owners are obviously too dense to have any common courtesy by dealing with it on their own.

Some of us work and have no choice but to keep our dog outside in a pen. However, that is not to say that I leave him out there all day long. He is allowed to come in the house when I am there. He is only chained when he goes outside. He must be chained or we will be fined. Also, we take him out walking/running every weekend, regardless of the weather.

I agree that some people chain up their dogs and forget about them, but a lot of us don't.

How is this fair to those of us that have dogs and our neighbor kids torment them and make them bark? Are we going to get fined b/c they are being teased?

I don't have a problem with the dogs in our neighborhood, but I do have a complaint against whoever rides their noisy 4-wheeler up and down 2nd st SW and revs it up at 11:00 pm when we are trying to sleep. Is that under the noise ordinance too?

I am at a loss for why people in town even own dogs/cats. What kind of life is it for any animal to be chained/penned up 24 hours a day/7 days a week? Little or no exercise (only allowed to roam as far as your chain or fence line allows) Not to mention that neighbors in town have to listen to dogs bark at all hours of the day. If these animal owners truly loved their animals, they would NEVER subject them to this lifestyle.

I think every dog owner who keeps their dog chained should have to spend a week in the same conditions...chained to a stake or a dog house.

This is hilarious I have called the police several times on my neighbors dogs because he let's them run loose and they poop in everyone's yard. The dog catcher gave them one warning once but that's it. Why call about loose dogs they won't do anything anyway. We have been grawled at several times. If any of my family ever get's bit by one of these dog's I won't waste my time calling the dog catcher I will take care of it myself.
